CiEy of Arden Hills Cha�ter 13 Zoning Code <br />C. Action to Approve. Action to approve an interim use permit requires a <br />majority vote of the full Council and must include a determination tk�at the <br />facts ax�d cixcumstances of the particular case warrant gran#ing the permit. <br />D. Permit Evaluaiion. When reviewing the interim use permit <br />application, the Cou�cil shall consider the factual findings, ability to ineet <br />the special requirements of the intenizxi use, and the conclusions and <br />recomrnendations of the Planning Commission. An interim use permit <br />may be granted only i�the City Council finds the following: <br />1. The use is allowed as an in�erz� us� in the underl�ing zoning <br />district and conforms io ihe zoning regulations; <br />2. Permission oithe interim use will not impose additional costs on <br />the public if it is necessary for the public to take the property in the <br />future; <br />3. The use will not adversely impact nearby properties through <br />nuisance, noise, dust, glare, or unsightliness, and will not otherwise <br />adversely irnpact the health, safeiy, and welfare of the community; <br />4. The use will not adversely impact traffic and parking; <br />S. The use will not adversely impact implementation o f the <br />Cornprehensive Plan; <br />6. The date or event that will terminate the use is identified with <br />certainty; <br />7. The applicant has signed a consent agreement agreeing that the <br />applicaz�t, owner, operator, tenant, and/or user has no entitlement ta an <br />extension of the Interim Use Permit; <br />8. The user agrees to all conditions that the City Council deems <br />appropriate for permission of the use including the requirement of <br />appropriate financial surety to cover �e cost of removing the interim <br />use and any interim structures upon expiration of the interim use <br />permit; <br />9. There are no delinquent praperty taxes, special assessments, <br />interest, or City utility fees due upon the subj ect parcel; <br />10. The term oithe interim use does not exceed three (3} years; <br />11. The property has not been a recipient of a previous interim use <br />permit.
