ANIMAL CONTROL CONTRACT <br />Tliis Agreement, �nade effective the iirst day of �anuary, 2011, by and between Anirnal Contral <br />Services, hereinafter refez�ec� to as "ACS," and the City of Arden Hills, a municipal corporation, <br />located in the County of Ramsey, State �f Mznnesota, herefnafter referred to as the "City". <br />In consideration of the co�venants a�d agreements, hereinafter set %rth, it is m.utually agreed by <br />and betvveen the parties, hereto, as follows: <br />1. Thi.s agreement will cantinue in effect until December 31, 2011, unless terminated as <br />provided herein. <br />2. ACS wiil provide Patrol services on tiae public streeis of �he City, in a vehicle suitable for <br />the transportation of small animals, in accordance with City Ordinances and a schedule <br />agreed upon. by both partias. The vehicle shall have propez identification displayed at ail <br />times. ACS shall n�aintain and insure such vehicles at a.11 times. In addition to patral <br />hours, AC� agrees to maintai� ai �east one vehicle for Ca11 Out service to attend to cases <br />outside regular patroi haurs at the s�ecific request of a la�v en%rcement agency as <br />approved by ihe City. <br />ACS shall provide competent personnel, trained in the handling of animals, in proper <br />uni�orm and ideniification including ern�loyee's f�st name a�d/or employee number. <br />4. The City authorizes ACS to apprehend and retain dogs, cats, and other animals, and/or <br />issue cita�on tags far violations of the City 4zdinances related to atumals. ACS wi�l not <br />take action on private properiy contrary to the expressed wishes of the owner af said <br />�aroperty, nor forcibly take ar� animal from any person, without the instructzon, approval, <br />and assistance of a duly licensed Mixu�.esota Peace O�ficer with current jurisdictian #hat <br />includes the private �raperty where the animal is located. <br />5. ACS shall impound and board animals as directed by written orde� of an authorizec� City <br />representative, or by ruling of the Minnesota Board of Healt.b. or other Minnesota or <br />United S�ates agency wi�th jurisdiction. <br />b. impounded anirz�als shall be checked for identification as requi�red by Miz�nesota 5tatutes <br />Chapter 34G a.n.d kept ai Hillcrest Anima� Hospital, 1320 Coux�ty Road D Cir Maplewaad, <br />MN 55109, {651) 484-7211, in a suitable, h�mane nanz�ex for the period specified i.� <br />paragraph 9. ACS may temporarily board at an ernergency faciIzty if access andlor <br />treahnent is z�ot immediately available at Hillcrest Anim� Hospital. <br />7. If an anaarz�a� is unclaimed, the City vviiI pay ACS the charges as agreed to on E�ibi# One <br />ta t.�is Agreement within thirty days of the Statement Daie. <br />Before an animal is released to its o�vvner, ACS or its agent shall callect the charges <br />specified on Exhibit Qne #o �lais Agreement. <br />
