A drainage and utility easement sha11 be extended along the rear of Block 4, Lot 18, <br />subject to the approval of the Public Works Director. <br />3. Execution of the Final Plat shall be cantingent upon the Metropolitan Council's <br />approval of the Comprehensive Plan Arnendment. <br />4. A development agreement sha11 be prepared by the Ciiy Attorney and subject to the <br />Ciiy Council approval. The development agraement shall be executed prior to <br />execution of the Fina� Plat. <br />5. The applicani sha11 construct an east-west boardvcralk connection from Keithson Drive <br />to the north-south trail east of the development, subject to the a�proval of the P�blic <br />Works Director. The cost of the construction of the trail shall be deducied from a <br />cash payment r�quirement of $133,248. The City shall use the park dedication ta <br />expand the City's parks, trails, and recreatian sysiem. <br />6. The applicani shall submit a fnancial surety, subject to ihe approval of the City <br />Attorney, for 125 percent af the cost of the landscaping improvements prior to the <br />issuance of any development permits. <br />"�. The applicant shall sub�nit a fin.ancial surety, subject to the approval of the Ciry <br />Attorney, for 100 percent o� the cost of site grading, retaining vvalls, utilities, and <br />street i�provements priar to tl�e issuance of development permits. <br />$. The proposed project may require permits, including, but not limited to, MPCA- <br />NPDES, Rice Creek Watershed District, Minnesota Department of Hea�th, MPCA- <br />Sanitary Sewer Extension, Raznsey Couniy and City Right of Way, and City Erosion <br />and Sed'rment Control permits. Copies of all issued perrnits shall be pravided to the <br />City prior to the issuance of any de�elopment permits. <br />9. Final grading, drainage, and utility plans shall be subject io approval of the P�blic <br />Works Director and City Engineer prior to the issuance of any developz�a.ent permits. <br />10. The plans shall be subject to Fire Marshal appro�al before developrzlent perinits are <br />issued. <br />11. The applicant sha11 complete grading activity and install the first lift of bituminous <br />surfacing prior to the issuance of any building permits, with the exception of those <br />homes aiong Arden View Drive. <br />I2. Sanitary sewer and water shall be accepied by the City and ready for haokup prior to <br />the issuance o� aza.y building permits. <br />13. The applicaz�t shall submii a Development Plan, subject to ihe approval af City Staif, <br />prior ta the issuance of any building permits. The Development Plan shall provide <br />as-built grading inforrriation together wi�li t�e style and minimum elevations �Far the <br />house an each lot. <br />14. There sha11 be no construction traffic out of the site ai Royal Hills Dr/Arden Vaew Dr <br />or Keithson Dr. All construction trafFc si�all enter and exit the site from Snelling <br />Avenue North, wvi�li �he exception of �he homes to be constructed along Arden View <br />Dr. <br />15. A copy of tl�e hoz�r�e owners' association (HOA} documents shall be kept on file with <br />the City, and shall clearly staie that the HOA shail be responsible far maintenance of <br />all retaining walls associaied with the approved grading plan.
