11.All parking lot and landscaping requirements are met or exceeded by the proposed <br />plans. <br />12.All Zoning regulations are met or exceeded by the proposed plans. <br />13.The design standards that can be applied to this application are substantially met by <br />the proposed plans. <br />14.Required number of parking stalls is exceeded by the proposed plans. <br />15.The project is subject to park dedication requirements. <br />City Planner Beekman stated Staff recommends approval of Planning Case #11-011 for a <br />Preliminary and final Plat, Zoning Code Amendment, and Master and final PUD at 1201 <br />County Road E subject to the following conditions: <br />1.The project shall be completed in accordance with the submitted plans as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and <br />City Council. <br />2.The applicant shall file the Final Plat with Ramsey County within one year of City <br />approval, or the approval for the Final Plat shall expire, unless extended by the City <br />Council prior to the approval’s expiration. Extension requests must be submitted in <br />writing to the City at least 45 days prior to the expiration date. <br />3.A development agreement, drafted by the City Attorney, shall be signed by the <br />property owners of both Lot 1 and Lot 2 prior to the execution of the Final Plat. <br />4.The applicant shall provide drainage and utility easements, in favor of the City, in <br />accordance with 1130.05 of the City Code, prior to the execution of the Final Plat. <br />5.The applicant shall dedicate to the City a ten-foot wide pedestrian easement along the <br />property line adjacent to County Road E, within which the six-foot wide sidewalk <br />shall be constructed. <br />6.A 25 by 25 foot easement shall be granted, in favor of the City, at the corner of <br />County Road E and Lexington Avenue for the purpose of a future civic <br />monument/gateway feature. In exchange for the easement, the City shall not ask the <br />developer to pay for any portion of the feature at the time it is installed. <br />7.The applicant shall provide for park dedication in an amount of $133,350. The park <br />dedication shall be paid in full prior to the execution of the Final Plat, or the property <br />owner shall enter into an agreement for a payment plan that is in accordance with <br />Section 1130.08 Subd E of the City Code. <br />8.The applicant shall obtain all necessary permits, including, but not limited to, <br />NPDES, Rice Creek Watershed District, Ramsey County, and City Erosion Control <br />Permits. Copies of all necessary permits shall be submitted to the City prior to the <br />issuance of any development permits. <br />9.Fire Hydrants shall be located within 150-feet of the Fire Department Connections <br />(FDC) to each building on Lot 1 and Lot 2. <br />10.The applicant shall submit a financial surety in a form acceptable to the City Attorney <br />for 125 percent of the cost of materials and installation of the landscaping plan prior <br />to the City issuing any development permits. The City shall retain the financial <br />surety for at least two years after full implementation of the landscaping plan. The <br />financial surety shall only be released upon successful inspection of the landscaping <br />by the City Planner, which shall only occur during the growing season. <br /> <br />
