EN HILLS <br /> MEMORANDUM <br /> DATE: December 14, 2005 Agenda Item 3.A <br /> TO: Honorable Mayor and City Councilmembers <br /> Michelle Wolfe, City Administrator <br /> FROM: Dave Scherbel, Building Official <br /> SUBJECT: Code Enforcement Issues <br /> CC: Karen Barton; Community Development Director <br /> John Mennenga; Building Inspector <br /> Background <br /> Staff seeks input and direction from council on a few zoning code enforcement issues. <br /> Waste Receptacles <br /> In the past, staff has spent considerable time on enforcing complaints regarding trash cans. <br /> Chapter 6, sec. G-2a of our zoning code reads as follows: <br /> "Containment. In all districts, all waste materials, debris, refuse, or garbage shall <br /> be kept in an enclosed building or be properly screened and contained in a closed <br /> container designed for such purpose so as not to be visible from adjoining <br /> properties or public streets." <br /> In addition, Section 620.04 of the City Code states: <br /> "The containers shall be kept in an accessible location for collection and shall be <br /> kept in a location on the owner's premises that is as nonconspicuous as <br /> practicable from adjoining premises." <br /> As policy, staff has allowed refuse containers to be placed on the side of the home, in the least <br /> conspicuous position, as long as they were not located in the front yard. Recently staff received <br /> a complaint on a refuse container being located in the front yard. When staff investigated the <br /> complaint, staff noticed that numerous other surrounding homes were also in violation. Staff <br /> ended up sending out over 20 letters for the refuse violation. Many of the homes were unable to <br /> properly screen the containers from adjacent properties and had to place the containers in the <br />
