In making these findings, the City Council shall consider the nature of the proposed use <br /> of land and the existing use of land in the vicinity, the number of persons to reside or <br /> work in the proposed subdivision and the probable effect of the proposed subdivision <br /> upon traffic conditions in the vicinity. In granting a variance as provided in this section, <br /> the Council shall prescribe only such conditions that it determines desirable or necessary <br /> to the public interest (Section 1150.01). <br /> 12. Additional Plan Review Comments—Plan review comments received from City staff, <br /> and the City Engineer <br /> A. Our Operations and Maintenance department has noted that the water and sewer <br /> mains will have to be tapped to supply service to the extra lots. The developer is <br /> responsible for the cost and installation of utilities to the properties. Work on utilities <br /> within the City right-of-way will require approval from the City's Operations and <br /> Maintenance department. <br /> Staff Recommendation <br /> In Planning Case#05-19 staff recommends approval of the Preliminary Plat for the Bryson <br /> Woods development , after making a finding that the proposed variances are not merely <br /> inconveniences, the conditions upon which the variances are based are unique to the property, <br /> and the variances will not be substantially detrimental to the public welfare and are in concert <br /> with City regulations; subject to the following conditions: <br /> A. Recording with Ramsey County. The applicant shall file the Final Plat with the <br /> Ramsey County recorder and shall provide the City with a recorded copy. <br /> B. Compliance with the City Code. The applicant shall comply with applicable provisions <br /> of the City Code and related ordinances. <br /> C. Park Dedication. Satisfaction of the park dedication requirement as approved by the <br /> City Council. <br /> D. Necessary Approvals from Other Agencies. The applicant shall obtain all necessary <br /> permits from the Rice Creek Watershed District, Ramsey County, the State of Minnesota <br /> Department of Natural Resources and any other governing agencies where applicable. <br /> Options <br /> 1. Recommend approval as submitted. <br /> 2. Recommend approval with conditions. <br /> 3. Recommend denial with reasons for denial. If the City denies the petitioners request, <br /> "...it must state in writing the reasons for the denial at the time it denies the request." <br /> 4.
