ATTACHMENTA <br />TheContractorshallrecordtheweightandgeneratorforallmaterialsenteringthefacilityona <br />daily,monthlyandannualbasis.TheserecordsshallbemadeavailabletoCityupon <br />TheContractorshallreporttotalweightofmaterialdisposedasshippedouttoamunicipalsolid <br />wastefacilitycomparedtothetotalmaterialshippedouteachmonthfromprocessing <br />2524.ChangingMarketDemand <br />2524.1LackofAdequateMarketDemand <br />IftheContractordeterminesthatthereisnomarketforaparticularrecyclableorthatthemarkethas <br />becomeeconomicallyunfeasible,theContractorshallimmediatelygivewrittennoticetotheCity.Said <br />noticeshallincludeinformationdemonstratingtheefforttheContractorhasmadetofindmarketsources <br />andthefinancialinformationjustifyingtheconclusionthatthemarketiseconomicallyunfeasible. <br />Economicunfeasibilityisdefinedasamarketinwhichmarketvaluereceivedforamaterialarelessthan <br />zero(0).Uponreceiptofsaidnotice,theContractorandtheCityshallhave30daystoattempttofinda <br />feasiblemarket.Duringthisperiod,theContractorshallcontinuetopickuptheparticularrecyclable. <br />IftheContractorortheCityisnotabletofindamarketwithin30days,theCityhastheoptionto: <br />a)RequiretheContractortocontinuetocollecttheparticularrecyclable.Insuchcase,theCitywould <br />paytheContractor,asadditionalcompensation,thetippingfeeattheNewportRDFplantora <br />mutuallyagreeablealternativesite.TheContractorisrequiredtokeepaccuraterecordsofsaidfees <br />andprovidetheCityreceiptsofpayment. <br />b)NotifytheContractortoceasecollectionoftheparticularrecyclableuntilafeasiblemarketis <br />located,eitherbytheContractororbytheCity.TheContractorwouldthenberesponsibleforthecost <br />ofprintinganddistributingeducationalmaterialsexplainingthemarketsituationtoresidents. <br />2524.2BurdensomeProcessingFeestotheCity <br />If,atitssolediscretion,theCitydeterminesthatprocessingfeeshavebecomeburdensomeforaparticular <br />recyclable,theCityshallimmediatelygivewrittennoticetotheContractor.Uponreceiptofsaidnotice,the <br />ContractorandtheCityshallhave30daystonegotiateacontractamendmentthatresultsin: <br />a)Theremovaloftheprocessingfeesfortheparticularrecyclable. <br />b)Theremovaloftheparticularrecyclablefromcollection.TheCitywouldthenberesponsiblefor <br />thecostofprintinganddistributingeducationalmaterialsexplainingthemarketsituationtoresidents. <br />Ifacontractamendmentisnotnegotiatedwithinthis30dayperiod,theContractorshallbe <br />responsibleforallprocessingfeesandtippingfees. <br />2625. <br />Eachcollectionvehicleshallbeequippedwiththe <br />TheContractor'svehiclesshallbemarkedwiththenameandtelephonenumbertheContractor <br />prominentlydisplayedonbothsidesofthetruck.Theletteringmustbeatleast3inchesin <br />2way <br />Firstaid <br />
