ATTACHMENTB <br />21.mustbe <br />TheContractorshallassuretheCitythatadequaterecyclablematerialprocessingcapacitywillbe <br />Cityatleast60 <br />providedforCitymaterialcollected.TheContractorshallprovidewrittennoticeto <br />daysinadvanceofanysubstantialchangeintheseorsubsequentplansreceivingandprocessing <br />recyclablescollectedfromthe <br />22.as <br />TheContractorshallconductatleastonematerialscompositionanalysisoftherecyclableseachyear <br />toestimatetherelativeamountbyweightofeachbygrade.Theresultsofthis <br />analysisshallinclude:(1)percentbyweightofrecyclablecommoditybygradeascollectedfromthe <br />City;(2)relativechangecomparedtothepreviousyear'scomposition;and(3)adescriptionofthe <br />methodologyusedtocalculatethecomposition,includingnumberofsamples,datesweighed,andCity <br />route(s)usedsampling.TheContractorshallprovidetheCitywithacopyofeachsuchanalysis. <br />23.ProcessR <br />TheContractorshallprovidetheCityawrittendescriptionofthemeanstoestimateresiduals <br />derivedfromtheCity'srecyclables.Thiswrittendescriptionshallbereviewedapprovedinwritingby <br />immediatelyafteranysignificant <br />theCity.Thiswrittendescriptionshallbeupdatedbythe <br />changestotheprocessingfacilitiesusedbythe <br />TheContractorshallrecordtheweightandgeneratorforallmaterialsenteringthefacilityona <br />daily,monthlyandannualbasis.TheserecordsshallbemadeavailabletoCityupon <br />TheContractorshallreporttotalweightofmaterialdisposedasshippedouttoamunicipalsolid <br />wastefacilitycomparedtothetotalmaterialshippedouteachmonthfromprocessing <br />24.ChangingMarketDemand <br />24.1LackofAdequateMarketDemand <br />IftheContractordeterminesthatthereisnomarketforaparticularrecyclableorthatthemarkethas <br />becomeeconomicallyunfeasible,theContractorshallimmediatelygivewrittennoticetotheCity.Said <br />noticeshallincludeinformationdemonstratingtheefforttheContractorhasmadetofindmarketsources <br />andthefinancialinformationjustifyingtheconclusionthatthemarketiseconomicallyunfeasible. <br />Economicunfeasibilityisdefinedasamarketinwhichmarketvaluereceivedforamaterialarelessthan <br />zero(0).Uponreceiptofsaidnotice,theContractorandtheCityshallhave30daystoattempttofinda <br />feasiblemarket.Duringthisperiod,theContractorshallcontinuetopickuptheparticularrecyclable. <br />IftheContractorortheCityisnotabletofindamarketwithin30days,theCityhastheoptionto: <br />a)RequiretheContractortocontinuetocollecttheparticularrecyclable.Insuchcase,theCitywould <br />paytheContractor,asadditionalcompensation,thetippingfeeattheNewportRDFplantora <br />mutuallyagreeablealternativesite.TheContractorisrequiredtokeepaccuraterecordsofsaidfees <br />andprovidetheCityreceiptsofpayment. <br />b)NotifytheContractortoceasecollectionoftheparticularrecyclableuntilafeasiblemarketis <br />located,eitherbytheContractororbytheCity.TheContractorwouldthenberesponsibleforthecost <br />ofprintinganddistributingeducationalmaterialsexplainingthemarketsituationtoresidents. <br />
