ATTACHMENTB <br />pollutantsiscausedbyorresultsformacoveredcauseof <br />automobiles <br />CommercialAutomobileLiabilityinsurancecoveringallowned,nonownedand <br />withlimitsofatleast$1,000,000peraccident.Thisinsuranceincludesaoflosswherethere <br />isaspilloffuelsandlubricantsusedinthevehicleforits <br />or& <br />Director'sOfficersInsuranceorErrorsOmissionsinsuranceprovidingcoverage <br />"wrongfulact''anyactualorallegederror,misstatement,misleadingstatement,act <br />omission,neglectorbreachofduty.Theinsurancepolicyprovides$1,000,000 <br />occurrenceand$1,000,000aggregatelimitofliabilityforeachyear. <br />AcceptanceoftheinsurancebytheCityshallnotrelieve,limitordecreasetheliabilityof <br />Contractor.AnypolicydeductiblesorretentionshallbetheresponsibilityoftheThe <br />Contractorshallcontrolanyspecialorunusualhazardsandberesponsiblefordamagesthat <br />resultfromthosehazards.TheCitydoesnotrepresentthattherequirementsare <br />sufficienttoprotecttheContractor'sinterestorprovideadequateEvidenceofcoverageis <br />datewrittennoticeis <br />tobeprovidedonaCityapprovedInsuranceCertificate.A <br />requiredifthepolicyiscanceled,notrenewedorchanged.TheContractorshallrequire <br />anyofitssubcontractorstocomplywith <br />38.of <br />TheContractorshallnotassignanyinterestinthecontract,andshallnottransferanyinthe <br />contract,eitherbyassignmentornotation,withoutthepriorwrittenapprovaloftheTheContractor <br />shallnotsubcontractanyservicesunderthiscontractwithoutpriorapprovaloftheCity.Failureto <br />obtainsuchwrittenapprovalbytheCitypriortoanyassignmentorsubcontractshallbegroundsfor <br />immediatecontract <br />TheContractorcurrentlysubcontractstoprovideservicetooldcorrugatedcontainerscustomers <br />thatrequiredumpstercapacity.ThissubcontractisannualandtheContractornotifytheCityin <br />writingifthereisachangein <br />and <br />ThepartiesherebyagreethattheContractorshallhavenorighttoassignortransferitsand <br />obligationsundersaidagreementwithoutwrittenapprovalfromtheCity.Intheevent,Contractor,its <br />agreementshallbeimmediately <br />successorsorassignsfilesforBankruptcyasprovidedbyfederallaw, <br />deemednullandvoidrelievingallpartiesoftheirrightsand <br />40.and <br />Thepartiesagreethatanycontroversyorclaimarisingoutoforrelatingtothisagreementthebreach <br />thereof,shallbesettled,attheoptionoftheContractorbyarbitrationwiththeRulesofthe <br />AmericanAssociationofArbitrationandjudgmentuponawardbytheArbitrator(s)maybeenteredin <br />anycourtwithjurisdiction <br />
