CONSENT ITEM <br /> <br />MEMORANDUM <br /> <br />DATE: <br />April 8, 2013 <br /> <br /> <br />TO: <br /> Honorable Mayor and City Council <br /> Patrick Klaers, City Administrator <br /> <br />FROM: <br />Meagan Beekman, City Planner <br /> <br />SUBJECT: Fox Ridge Park Dedication Escrow Release <br /> <br /> <br /> <br />Requested Action <br /> <br />Motion to authorize refund to Pulte Homes in the amount of $30,000 for the construction of a <br /> <br />trail segment as part of the Fox Ridge residential subdivision. <br /> <br />Background <br /> <br />The City Council approved the Final Plat and Development Agreement for the Fox Ridge <br />project on April 25, 2011. The approval was for a 39-unit single family residential <br />subdivision. The developer, Pulte Homes, began site work in June 2011, and completed the <br />first model home on the property in the fall of 2011. <br /> <br />At this time all 39 parcels have been sold. 38 building permits for new home construction <br />have been issued, 25 of the homes are complete, and 12 of the homes are substantially <br />complete with minor items outstanding such as sod and tree installation. <br /> <br />Park Dedication <br /> <br />At the time of the approval of the Final Plat, the City Council required a park dedication fee <br />of $133,248. The amount was the highest permitted by the City Code and was based on the <br />density of the project and the value of the land at the time of subdivision. As part of the park <br />dedication amount, the City Council required the developer to construct a trail connection <br />from Keithson Avenue to the north-south trail that runs along the east side of the <br />development area.
