O-AD-B,LLC <br />TOGAWANSCHEL ESIGNUILD <br />GSV <br />ARAGE ETBACK ARIANCE <br />11/04/2013 <br />2a) The plight of the landowner is due to unique site conditions, notably a <br />lakefront lot with a steep incline and existing garage proximity to right-of- <br />way, that pre-date the landowner’s ownership and use of the property <br />3.The deviation from the Ordinance with any attached conditions will still be in keeping <br />with the spirit and intent of the Ordinance <br />3a) Otogawa-Anschel Design-Build, LLC believes the spirit and intent of the <br />Ordinance will remain intact with the proposed construction of an <br />aesthetically pleasing, updated and structurally-sound garage that utilizes no <br />more of the lot than the original structure, minimizing overall site-impact and <br />maintaining if not improving groundwater infiltration in the process <br />3b) The setback from right-of-way with the proposed plan will be no further <br />encroached upon than the existing structure <br />4.The variance will not create a land use not permitted in the zone <br />4a) The land use of the proposed structure will remain the same as the <br />structure currently, which is in line with the current zoning of the parcel <br />5.The variance will not alter the essential character of the City <br />5a) Otogawa-Anschel Design-Build, LLC believes that the essential character <br />of the City will not be altered with the proposed structure, and further <br />believes the landowners’ investment in their property will improve the <br />streetscape and promote healthy investment in neighboring properties as well <br />6.The variance is not for economic reasons alone <br />6a) The variance requested for the property is not for economic reasons. <br />Primary drivers for requesting the variance are directly in line with drivers for <br />initiating a remodel of the garage, including the aforementioned landowners’ <br />safety concerns with the exposed stair and the structural repairs needed, and <br />reducing site impact of what construction does take place. <br />
