A variance is being requested to encroach into the <br />front yard setback in order to construct the four (4) foot overhang for the stairway. The <br />proposed overhang will encroach no further into the setback than the existing structure on <br />the property. <br />C.Structure Height –MeetsRequirements for non-conforming structures <br />The Zoning Code states that accessory structures in the R-2Districtshall not exceed <br />fifteen (15) feet or the height of the principal structure to which it is accessory, whichever <br />is lower. The existing structure has an average height of sixteen (16) feet three (3) inches <br />based on the vertical distance from grade plane to the average height of the highest roof <br />surface.
