ARDEN HILLS CITY COUNCIL JANUARY 13, 201413 <br /> <br />1. The project shall be completed in accordance with the plans submitted as amended by the <br />conditions of approval. Any significant changes to these plans, as determined by the City <br />Planner, shall require review and approval by the Planning Commission and City Council. <br />2. A PUD Amendment drafted by the City Attorney shall be executed prior to the issuance of <br />a building permit. <br />3. The applicant shall acquire a Grading and Erosion Control Permit prior to commencing <br />land disturbing activities on the site. <br />4. The Master PUD Amendment and Site Plan Review shall automatically expire and <br />become void one (1) year after the date on which the Council granted such approval if <br />work on the project has not begun. <br />5. If noise from Building 14 exceeds MPCA noise regulations for residential areas at the <br />property line, the applicant shall reduce noise levels in order to be in compliance with <br />MPCA regulations. If the City receives complaints regarding noise levels, the applicant <br />shall be responsible for providing decibel measurements from the property line and <br />reducing noise levels to be in compliance with MPCA regulations. <br /> <br />Mayor Grant <br />thanked Associate Planner Bachler for his presentation and asked for Council <br />comments and questions. <br /> <br />Councilmember Holden <br /> asked what would happen if the noise levels were not below the <br />recommended MPCA standards. <br /> <br />Associate Planner Bachler <br /> explained that condition 5 was included to address this concern. The <br />condition states that if noise from Building 14 exceeds MPCA noise regulations for residential <br />areas at the property line, the applicant shall reduce noise levels in order to be in compliance with <br />MPCA regulations. If the City receives complaints regarding noise levels, the applicant shall be <br />responsible for providing decibel measurements from the property line and reducing noise levels <br />to be in compliance with MPCA regulations. <br /> <br />Councilmember Holden <br /> questioned if additional spruce trees could be added. She commented <br />that this may benefit the two adjacent residential homes. <br /> <br />Associate Planner Bachler <br /> stated that the two spruce trees were required due to the building <br />space that was being added to the property, and not because of the noise or screening issues. It <br /> <br /> <br />Councilmember Holden <br /> was in favor of requiring the applicant to plant additional spruce trees <br />on the property line. She asked if Boston Scientific had any temporary use permits in place. <br /> <br />Associate Planner Bachler <br /> reported that Boston Scientific had a temporary use permit for the <br />walkway that connects Building 3 and Building 10. He stated that the applicant has filed for an <br />extension of this temporary use permit. <br /> <br />Councilmember Holmes <br /> asked for further clarification as to where the noise from this property <br />will be coming from. <br /> <br />
