Conditional Use Permit Amendment – Section 1355.04 Subd 3 <br /> <br />Section 1320.13 Special Requirements for the Gateway Business (GB) District of the Arden <br />Hills Zoning Code states that site modification proposals in the GB District shall be reviewed <br />according to the criteria for evaluating Conditional Use Permit (CUP) Amendments as listed in <br />Section 1355.04 Subd 3. <br /> <br />The Planning Commission and City Council shall consider the effect of the proposed use upon <br />the health, safety, convenience and general welfare of the owners and occupants of the <br />surrounding land, in particular, and the community as a whole, in general, including but not <br />limited to the following factors: <br /> <br />1. Existing and anticipated traffic and parking conditions; <br />2. Noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and <br />other nuisance characteristics; <br />3. Drainage; <br />4. Population density; <br />5. Visual and land use compatibility with uses and structures on surrounding land; <br />6. Adjoining land values; <br />7. Park dedications where applicable; and the <br />8. Orderly development of the neighborhood and the City within the general purpose and <br />intent of this ordinance and the Comprehensive Development Plan for the City. <br /> <br /> <br />3. Section 1325 – General Regulations <br /> <br />Regulation: 1325.05 Subd. 4 Screening of Mechanical Operating Equipment of the Zoning Code <br />requires that above ground storage tanks shall be screened from the view of adjacent streets and <br />differing land uses. Fences used for screening shall conform to the requirements for fencing in <br />this Section. <br /> <br />Proposal: The proposed storage tank would be placed within the existing screening fence that is <br />constructed with galvanized chain-link fencing and tan colored slates. The tank would be placed <br />horizontally behind the screening fence approximately seven (7) feet from the outside wall of the <br />building. The double walled constructed tank is approximately five and one half (5.5) feet in <br />height, fifteen (15) feet in length by three and one half (3.5) feet in diameter. The tank as <br />proposed would not be taller in height than the existing screening fence. <br /> <br />Regulations: Section 1325.07 Subd 5. Environmental Pollution of the Zoning Code requires that <br />emissions or creation of noise, odors, vibrations, glare, dust, smoke, heat and toxic or noxious <br />fumes shall conform to such standards as are from time to time established by the Minnesota <br />Pollution Control Agency. None of these shall be at a level that is objectionable to surrounding <br />properties.
