2. Subdivision Ordinance

Section 1150.04 of the City Code lists the requirements for subdividing and/or consolidating
previously platted property. Requirements that must be evaluated listed under Section 1150.04
include:

1. Survey: A survey showing the existing and proposed lots.
2. Zoning Compliance: The parcels or tracts resulting from the division or consolidation, as
depicted in the survey or registered land survey, shall not have an area, dimensions, or
setbacks which are less than the minimum requirements specified for the zoning district
in which the parcels or tracts are located in the zoning ordinance.
3. Public Welfare: It is determined that the proposed division or consolidation will not be
detrimental to the public welfare or injurious to adjacent tracts in the area in which the
subdivision tract is located.
4. Conformity with the rest of the Subdivision Ordinance: The proposed division or
consolidation shall conform to all requirements of the subdivision Ordinance unless given
an exemption by the Planning Commission and City Council.
5. Fees: All filing fees must be paid.

Additional Review

City Engineer
The Public Works Department has reviewed the proposed Minor Subdivision and has requested
that the property owners work with the City to provide a sanitary sewer easement over the
existing sewer line that crosses the two properties and a storm sewer easement over the existing
utility line at the northwest corner of 3535 Siems Court.

City Attorney
The City Attorney has reviewed the proposed Minor Subdivision and recommended that the City
request 12 foot easements centered on rear and other lot lines for utilities and drainage purposes.

Findings of Fact

The Planning Commission must make a finding as to whether or not the proposed application
would adversely affect the surrounding neighborhood or the community as a whole based on the
aforementioned factors. Staff offers the following findings for consideration:

1. LoAnn Crepeau and Thomas Ostby are the owners of the property located at 3517 Siems
Court.
2. The applicant has requested a Minor Subdivision to sell a 5,540 square foot portion of
land to the adjacent property owner at 3535 Siems Court.

City of Arden Hills
Planning Commission Meeting for May 6, 2015
P:\Planning\Planning Cases\2015\PC 15-010 - Minor Subdivision - 3517 Siems Court\Memos_Reports_15-010
