<br />City of Arden Hills <br />Planning Commission Meeting for May 6, 2015 <br /> <br />P:\Planning\Planning Cases\2015\PC 15-012 - PUD Amendment - Caribou Coffee - Shannon Square\Memos_Reports_15-012 <br />Page 9 of 10 <br />Recommendation <br /> <br />Based on the submitted plans and findings of fact, staff recommends approval of Planning Case <br />15-012 for a Planned Unit Development (PUD) Amendment for a drive-thru lane and pick-up <br />window at 3673 Lexington Avenue North. If the Planning Commission recommends approval of <br />this request, staff recommends that the following seven (7) conditions be included with the <br />approval: <br /> <br />1. That the project shall be completed in accordance with the submitted plans as <br />amended by the conditions of approval. Any significant changes to these plans, as <br />determined by the City Planner, shall require review and approval by the Planning <br />Commission and City Council. <br />2. That the applicant shall continue to abide by all previous agreements, as amended by <br />the conditions of approval of this application. <br />3. That a Planned Unit Development (PUD) Amendment shall be prepared by the City <br />Attorney and subject to City Council approval. The PUD agreement shall be signed <br />by the applicant and approved by Council prior to the issuance of any building <br />permits. <br />4. That a building permit, grading and erosion control permit, and RCWD permit shall <br />be obtained for the proposed project. <br />5. That the building permit for the addition shall be issued by June 1, 2016, or an <br />extension shall be requested at least 45 days preceding this deadline. <br />6. That the applicant shall submit a financial surety in the amount of 125 percent of the <br />estimated costs of landscaping (materials and installation) prior to the issuance of a <br />building permit. The financial surety shall be in the form of a letter of credit issued by <br />a FDIC -insured Minnesota bank. The purpose of the letter of credit is to ensure that <br />landscaping is completed in the event that the applicant defaults on the Conditional <br />Use Permit Amendment Agreement. The City will hold the letter of credit for two <br />years after the installation of landscaping. The letter of credit should not expire during <br />the two-year period. <br />7. That no additional wall signage beyond what is permitted in the Zoning Code shall be <br />permitted as part of this application. The additional signage depicted within the <br />Development Plan Set A1.1 is not being considered at this time. <br /> <br /> <br />Proposed Motion Language <br /> <br />1. Recommend Approval with Conditions: Motion to recommend approval of Planning Case <br />15-012 for a Planned Unit Development (PUD) Amendment for a drive-thru lane and pick-up <br />window at 3673 Lexington Avenue North, based on the findings of fact, submitted plans, and <br />the seven (7) conditions in the May 6, 2015, report to the Planning Commission. <br /> <br />2. Recommend Approval as Submitted: Motion to recommend approval of Planning Case 15- <br />012 for a Planned Unit Development (PUD) Amendment for a drive-thru lane and pick-up
