The City Council may place conditions on a permit if deemed necessary to protect the health, safety, and general welfare of the community. Conditional Use Permits are granted for a specific use at a specific site and are not transferable. Section 1325 – General Regulations A. Tree Preservation – Flexibility Requested The applicant submitted a Tree Survey and Tree Replacement Plan as part of their tree preservation and mitigation requirements (Attachment B). The following table outlines these numbers and the additional requirements of the tree preservation ordinance pertaining to tree removal and tree mitigation regulations. Development of the site as proposed requires extensive tree removal. The applicant has stated their intent to develop the lot in such a way that preserves as many highest quality trees as possible, knowing that many of the significant trees will have to be removed in order for the lot to be developed into a viable use. In total 90 trees will be planted, equating to 310 caliper inches. Based on the proposed tree removal, the City’s Tree Preservation Ordinance requires 395 caliper inches to be planted. The applicant is requesting flexibility to reduce the amount of caliper inches required from 395 to 310, which is a reduction of 85 caliper inches. City Code requires a certain number of caliper inches to be planted. If larger trees are planted then fewer trees would be required. Trees proposed to be planted will consist of desirable and native tree species such as Northern Red Maple, Swamp White Oak, Common Hackberry, Princeton Elm, Bur Oak, Black Hills Spruce and White Fir.
