Requirements for Parking, Loading and Circulation – Section 1325.06 <br /> <br />Setbacks - Variance Required <br />Section 1325.06, Subdivision 1 of the Zoning Code requires that an off-street parking area <br />containing four or more parking spaces be located a minimum of five feet from any side or rear <br />lot lines. The existing parking area for the Big Ten property encroaches into this required five <br />foot setback along the northwest and southeast side lot lines and the southwest rear lot line. With <br />the expansion of the lot boundaries, the parking lot would continue to encroach along the <br />southeast lot line. <br /> <br /> <br />2. Subdivision Ordinance <br /> <br />Section 1150.03 of the City Code lists the following evaluation criteria for minor subdivisions of <br />unplatted property. Instead of requiring that the subject property be entirely replatted, the <br />subdivision may be processed by means of a registered land survey provided that the following <br />requirements have been met: <br /> <br />1. The resultant parcels abut on and have access to an existing public street, road, <br />thoroughfare or highway; <br />2. The subdivision will not involve the opening, widening or extension of any public or <br />private street, road, thoroughfare or highway and will not involve the dedication, <br />reservation or construction of any type of public utility; <br />3. The subdivision will not obstruct future streets which have been planned by the City; <br />4. The subdivision will not be detrimental to the public welfare or injurious to adjacent <br />tracts in the area in which the subdivision tract is located; <br />5. The registered land survey conforms in all respects to the provisions of M.S. § 508.47 <br />(4), as amended, and the terms of which are incorporated herein by reference. <br />6. Monuments or stakes shall be placed and installed at all corners and angle points of the <br />resultant parcels; <br />7.
