The financial surety shall be in the form of a letter of credit issued by a <br />FDIC-insured Minnesota bank. The purpose of the letter of credit is to ensure that <br />landscaping is completed in the event that the applicant defaults on the Conditional Use <br />Permit Amendment Agreement. The City will hold the letter of credit for two years after <br />the installation of landscaping. The letter of credit should not expire during the two-year <br />period. <br />7. That a minimum of two (2) trees shall be planted on the Ona Orth Athletic Field complex <br />to meet the Zoning Code requirements. Each deciduous tree is required to be a minimum <br />of two and one-half (2.5) caliper inches and coniferous trees are required to be six (6) feet <br />in height. <br /> <br /> <br />Proposed Motion Language <br /> <br />1. Approve the proposal as submitted. <br />2. Approve the proposal with conditions (Recommended Action). <br />3. Deny the application with reasons for denial. <br />4. Table for additional information. <br /> <br /> <br />Public Notice <br /> <br />Notice of the public hearing was published in the Shoreview-Arden Hills Bulletin on April 22, <br />2015, and mailed to all properties within 500 feet of the subject property. <br /> <br /> <br />Public Comments <br /> <br />Staff received an email from Thomas House (1483 Arden Oaks Drive) outlining his concerns <br />regarding the Ona Orth Athletic Field complex (Attachment G). Staff has been in contact with <br />Bethel University and they are working with Mr. House to address the noise related issues <br />addressed in the email received by staff. No other letters, e-mails, or telephone calls from <br />property owners or residents in regards to this planning case have been received. <br /> <br /> <br />Deadline for Agency Actions <br /> <br />The City of Arden Hills received the completed application for this request on April 1, 2015. <br />Pursuant to Minnesota State Statue, the City is required to act on this request by May 30, 2015, <br />(60 days), unless the City provides the petitioner with written reasons for an additional 60-day <br />review period. <br />
