CONSENT ITEM – 5D <br /> <br />City of Arden Hills <br />City Council Meeting for May26, 2015 <br /> <br />P:\Planning\Planning Cases\2015\PC 15-009 - CUP Amendment - Bethel University - Soccer Building\Memos_Reports_15-009 <br />Page 6 of 8 <br />Conditional Use Permit Evaluation Findings: <br />14. The proposed project would not have any impact on traffic or parking conditions because <br />the use is accessory to the campus as a whole, and only provides facility space for soccer <br />events that would already be held at this location. <br />15. The proposed project will not produce any permanent noise, glare, odors, vibration, <br />smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics. <br />16. The proposed project will not impact drainage. <br />17. The proposed project will not impact population density. <br />18. The proposed project is not expected to have a visual impact on surrounding properties or <br />on land use compatibility with uses and structures on surrounding land or adjoining land <br />values. <br />19. Park dedications are not applicable. <br />20. The proposed project does not conflict with the general purpose and intent of the Zoning <br />Code or the Comprehensive Development Plan for the City. <br /> <br /> <br />Recommendation <br /> <br />The findings of fact for the Conditional Use Permit (CUP) Amendment support approval. <br />However, if the City Council chooses to deny the application, the findings of fact would need to <br />be amended to reflect the reasons for the denial. <br /> <br />The Planning Commission reviewed Planning Case 15-009 and unanimously recommends <br />approval (5-0) of the Conditional Use Permit (CUP) Amendment in order to construct a soccer <br />facility building on the Ona Orth Athletic Field complex located at 3900 Bethel Drive, based on <br />the findings of fact and the submitted plans as presented in the May 26, 2015, Report to the City <br />Council, as amended by the following seven (7) conditions: <br /> <br />1. That the project shall be completed in accordance with the plans submitted as amended <br />by the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and City <br />Council. <br />2. That the applicant shall continue to abide by all previous agreements and Conditional Use <br />Permits, as amended by the conditions of approval of this application. <br />3. That a Conditional Use Permit Amendment Agreement shall be prepared by the City <br />Attorney and subject to City Council approval. The CUP agreement shall be signed by <br />the applicant and approved by Council prior to the issuance of any building permits. <br />4. That a building permit shall be obtained for the proposed soccer facility building. <br />5. That the building permit for the soccer facility shall be issued by June 1, 2016, or an <br />extension shall be requested at least 45 days preceding this deadline. <br />6. That the applicant shall submit a financial surety in the amount of 125 percent of the <br />estimated costs of landscaping (materials and installation) prior to the issuance of a
