ARDEN HILLS PLANNING COMMISSION – May 6, 2015 3 <br /> <br />12. The proposed soccer facility building meets all other requirements of the Zoning Code. <br />13. No additional parking areas, drives, or access points would be created as a result of the <br />proposed project at the Ona Orth Athletic Field complex. <br /> <br />Conditional Use Permit Evaluation Findings: <br />14. The proposed project would not have any impact on traffic or parking conditions because <br />the use is accessory to the campus as a whole, and only provides facility space for soccer <br />events that would already be held at this location. <br />15. The proposed project will not produce any permanent noise, glare, odors, vibration, <br />smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics. <br />16. The proposed project will not impact drainage. <br />17. The proposed project will not impact population density. <br />18. The proposed project is not expected to have a visual impact on surrounding properties or <br />on land use compatibility with uses and structures on surrounding land or adjoining land <br />values. <br />19. Park dedications are not applicable. <br />20. The proposed project does not conflict with the general purpose and intent of the Zoning <br />Code or the Comprehensive Development Plan for the City. <br /> <br />City Planner Streff stated that based on the submitted plans and findings of fact, staff <br />recommends approval of Planning Case 15-009 for a Conditional Use Permit (CUP) Amendment <br />in order to construct a soccer facility building on the Ona Orth Athletic Field complex located at <br />3900 Bethel Drive. If the Planning Commission recommends approval of this request, staff <br />recommends that the following seven (7) conditions be included with the approval: <br /> <br />1. That the project shall be completed in accordance with the plans submitted as amended <br />by the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and City <br />Council. <br />2. That the applicant shall continue to abide by all previous agreements and Conditional Use <br />Permits, as amended by the conditions of approval of this application. <br />3. That a Conditional Use Permit Amendment Agreement shall be prepared by the City <br />Attorney and subject to City Council approval. The CUP agreement shall be signed by the <br />applicant and approved by Council prior to the issuance of any building permits. <br />4. That a building permit shall be obtained for the proposed soccer facility building. <br />5. That the building permit for the soccer facility shall be issued by June 1, 2016, or an <br />extension shall be requested at least 45 days preceding this deadline. <br />6. That the applicant shall submit a financial surety in the amount of 125 percent of the <br />estimated costs of landscaping (materials and installation) prior to the issuance of a <br />building permit. The financial surety shall be in the form of a letter of credit issued by a <br />FDIC-insured Minnesota bank. The purpose of the letter of credit is to ensure that <br />landscaping is completed in the event that the applicant defaults on the Conditional Use <br />Permit Amendment Agreement. The City will hold the letter of credit for two years after <br />the installation of landscaping. The letter of credit should not expire during the two-year <br />period. <br />7. That a minimum of two (2) trees shall be planted on the Ona Orth Athletic Field complex <br />to meet the Zoning Code requirements. Each deciduous tree is required to be a minimum
