Chapter 11, Subdivision Regulations Review <br /> <br />A. Street Plan & Streets <br /> <br />No new streets are being constructed for the Valentine Bluff development. All seven (7) lots <br />will have access from County Road E2 through four (4) access points. Limiting driveways <br />from County Road E2 is accomplished by incorporating shared access from the County <br />roadway. The plans as submitted indicate that every other property would share an access <br />with the neighboring property, except the easternmost lot would have its own individual <br />access from County Road E2. All other requirements pertaining to street access, driveway <br />locations and the finished grade of these facilities are met by the proposed plans. <br /> <br />B. Easements <br /> <br />City subdivision regulations require twelve (12) foot wide utility and drainage easements <br />dedicated to the City along the right-of-way and centered on common lot lines. The plat <br />includes twelve (12) foot utility and drainage easements that are centered on the common lots <br />lines throughout the development and a twelve (12) foot easement along the County Road E2 <br />right-of-way and along the northern property line adjacent to Tony Schmidt Regional Park. <br />The easements in these areas meet the City’s subdivision regulations. All utility and <br />drainage easements will be dedicated to the public as required by the Subdivision Code. <br /> <br />In addition, a sixty-eight (68) foot park, trail, and recreational easement has been provided by <br />the applicant to the Ramsey County Parks and Recreation Department for the purpose of a <br />future trail connection through the wetland complex in Tony Schmidt Regional Park. This <br />easement area is located across the western portion of proposed Lot 1. <br /> <br />C. Park Dedication <br /> <br />The Subdivision Ordinance requires developers of subdivisions to dedicate to the public a <br />reasonable percentage of the tract to be developed. Section 1130.08 Subd. 2 of the <br />Subdivision Ordinance indicates that for a subdivision that results in new dwelling units less <br />than two units per acre, the applicants shall dedicate six percent of the buildable land area in <br />the subdivision or pay a park dedication fee of six percent of the property’s land value. <br /> <br />The City Attorney has indicated that a park dedication based on the purchase price of the two <br />properties is appropriate in this Planning Case. The current purchase agreement between <br />Landmark of Arden Hills, LLC (Developer/Purchaser), and Bethel University (Owner/Seller) <br />indicates a purchase price of $856,000 for the two properties. Based on the purchase price <br />the park dedication if paid in a fee would be $51,360.
