MEMORANDUM <br /> <br />DATE: April 8, 2015 PC Agenda Item 3.A <br /> <br />TO: Planning Commission <br /> <br />FROM: Matthew Bachler, Associate Planner <br /> <br />SUBJECT: Planning Case #15-006 - Public Hearing Required <br /> Applicant: Big Ten Supper Club <br /> Property Location: 4703 U.S. Highway 10 <br /> Request: Conditional Use Permit – Deck Addition and Existing Restaurant Use <br /> <br />Requested Action <br /> <br />The Big Ten Supper Club has requested a Conditional Use Permit (CUP) for a proposed deck <br />addition to the existing restaurant building located at 4703 U.S. Highway 10. The requested CUP <br />would also encompass the existing restaurant on the property. <br /> <br /> <br />Background <br /> <br />The Big Ten Supper Club has operated on the property at 4703 U.S. Highway 10 since 1959. The <br />property was rezoned in 2000 from B-2 - General Business District to NB - Neighborhood <br />Business District. As a result of the rezoning, the existing restaurant use became a legal <br />nonconforming use under the Zoning Code because it operates without a CUP, which is required <br />for all restaurant uses in the NB District. The Zoning Code states that nonconforming uses may <br />continue, however, they cannot be expanded. In this case, a CUP is required for the deck addition <br />to bring the property into compliance with the CUP requirements of the Zoning Code. <br /> <br /> <br />1. Overview of Request <br /> <br />The Big Ten Supper Club is requesting a CUP for a deck addition measuring 18 feet by 18 feet, a <br />total area of 324 square feet, which would be located on the northwest side of the existing <br />restaurant building. The purpose of the deck addition is to provide outdoor seating to <br />accommodate approximately 20 seats. Access to the seating area would be provided through a <br />set of double doors that will be constructed along the north building wall.
