CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: April 6, 2001 <br /> TO: Mayor and City Council <br /> FROM: Jennifer Chaput, City Planner Cf <br /> SUBJECT: Case#01-07,Lakeshore Setback Variance <br /> Jon Lundin, 1164 Amble Drive <br /> Request <br /> The applicant is requesting a variance from the ordinary high water mark setback of Karth Lake(43 <br /> feet proposed(with cantilever),when 75 feet is required) for the expansion of an existing deck with <br /> an enclosed patio on grade. <br /> Background <br /> The applicant is requesting a variance to replace an existing deck with a slightly larger deck (-45 <br /> square feet greater), locating no closer to the Ordinary High Water(OHW) setback from Karth Lake <br /> than it already exists (45'where 75'is required). However, a cantilever is proposed that would be 2' <br /> closer, creating the need for a variance of 43' from the OHW of Karth Lake. Below the deck, on <br /> grade, an enclosed patio would also be constructed within the boundaries of the proposed deck.Plans <br /> for this proposal were provided to the City Council as part of the April 4 Planning Commission <br /> packet. <br /> This is the second variance from the OHW of Karth Lake within the last six months. The Planning <br /> Commission has directed staff to amend the setback requirement from this lake for the May Planning <br /> Commission meeting. Minnesota Rules 6120.3200 states that lakes classified as "general <br /> development" (Karth Lake) should have a structure setback of 75' from the ordinary high water level <br /> for unsewered lots and 50' for sewered lots. The Planning Commission has based their <br /> recommendation on the assumption that this language will be amended in May and adopted by the <br /> City Council later that month. They have recommended that development on this property be <br /> permitted no closer than 50' to the lake. <br /> Deadline for Agency Actions <br /> The City of Arden Hills received the completed application for this request on March 12, 2001. <br /> Pursuant to Minnesota State Statute, the City must act on this request by May 11, 2001 (60 days), <br /> unless the City provides the petitioner with written reasons for an additional 60-day review period. <br /> The additional review period would extend to July 10, 2001. The City may with the petitioners <br /> consent, extend the review period beyond the date. <br />
