ARDEN HILLS PLANNING COMMISSION – May 6, 2015 12 <br /> <br /> <br /> <br />C. Planning Case 15-010; Minor Subdivision – LoAnn Crepeau and Thomas Ostby – <br />3517 Siems Court – Public Hearing <br /> <br />Associate Planner Bachler stated that the owners of the property at 3517 Siems Court have <br />applied for a Minor Subdivision to sell a 5,540 square foot portion of land to the adjacent <br />property owner at 3535 Siems Court. The new property line would add approximately 40 feet of <br />shoreline to the property at 3535 Siems Court. No new construction or change in use is <br />contemplated as part of the Minor Subdivision request. <br /> <br />Associate Planner Bachler indicated that the land to be transferred includes an existing two- <br />story boathouse with a footprint of 450 square feet. This structure is considered to be a legal <br />nonconforming building because of an encroachment in the required setbacks from the Lake <br />Johanna shoreline and the side property line. With the proposed lot line adjustment, the <br />boathouse would still be within the required setback from the shoreline, but the ten-foot side yard <br />setback for accessory structures would be met. The adjacent property owners at 3535 Siems <br />Court plan to make improvements to the boathouse, but no expansion of the building would be <br />undertaken. <br /> <br />Associate Planner Bachler reported that the Minor Subdivision would leave both lots in <br />conformance with the Zoning Code requirements for lot size and lot coverage, and would not <br />create any new or increase existing nonconforming setbacks for the structures on the lots. <br /> <br />Site Data <br />Land Use Plan: Low Density Residential <br />Existing Land Use: Single Family Detached <br />Zoning: R-1 Single-Family Residential District <br />Current Lot Sizes: 36,982 square feet (0.85 acres) <br />Topography: Sloping down towards Lake Johanna (elevation change of <br />approximately 30 feet) <br /> <br />Associate Planner Bachler reviewed the surrounding area and the Plan Evaluation. <br /> <br />Associate Planner Bachler explained that the Planning Commission must make a finding as to <br />whether or not the proposed application would adversely affect the surrounding neighborhood or <br />the community as a whole based on the aforementioned factors. Staff offers the following <br />findings for consideration: <br /> <br />1. LoAnn Crepeau and Thomas Ostby are the owners of the property located at 3517 Siems <br />Court. <br />2. The applicant has requested a Minor Subdivision to sell a 5,540 square foot portion of <br />land to the adjacent property owner at 3535 Siems Court. <br />3. The properties at 3517 Siems Court and 3535 Siems Court are located in the R-1 Single- <br />Family Residential Zoning District. <br />4. Section 1150.04 of the City Code lists the requirements for subdividing and/or <br />consolidating previously platted property.
