CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: June 13, 2001 <br /> TO: Mayor and City Council <br /> FROM: Mike Cronin, Interim City Planner <br /> SUBJECT: Planning Case #01-19, Minor Subdivision and Consolidation <br /> Walter and Dolores Dunnett, 1543 Oak Avenue <br /> Request <br /> The applicant is requesting that the property at 1543 Oak Avenue be subdivided and <br /> consolidated with the property at 3651 Snelling Avenue, described as "Parcel B" on the <br /> survey (Exhibit A). <br /> Background <br /> In the past, the house located at 3651 Snelling Avenue was built across the property line <br /> that it shares with 1543 Oak Avenue. This became an ongoing dispute between <br /> neighbors, recently resolved through legal proceedings. The property owners agreed that <br /> Mary Ann Bown (Exhibit B), property owner of 1543 Oak Avenue, would sell a portion <br /> of her property (legally described on the survey as "Parcel B", 785 square feet) to Walter <br /> and Dolores Dunnett (Exhibit C) at 3651 Snelling Avenue. <br /> Therefore, a minor subdivision is required to split Parcel B from Parcel A (1543 Oak <br /> Avenue) and consolidate Parcel B with the property located at 3651 Snelling Avenue. <br /> The proposed parcel of land will permit the home at 3651 Snelling Avenue to be in <br /> compliance with the setback requirements of the Zoning Ordinance. <br /> Procedural Requirements & Review <br /> Minor Subdivision <br /> Section 22-12, (e) of the City Code authorizes the division of platted lots of record if the <br /> following conditions are met: <br /> 1. The owner of the platted lot to be so divided shall file with the zoning administrator a <br /> survey of the lot to be divided. A survey of the property as it exists for 1543 Oak <br /> Avenue was submitted. <br /> 2. The parcels resulting from such division, as depicted in said survey, shall not have an <br /> area, dimensions, or setbacks which are less than the minimum requirements <br /> specified for the zoning district in which the parcels are located in the zoning <br /> ordinance. The minor subdivision creates parcels A and B from the existing 1543 <br />
