Oak Avenue parcel. The existing house will be located on Parcel A, maintaining the <br /> same structure setbacks and creating a parcel 96,853 square feet in area. Parcel A <br /> meets all of the minimum dimensional requirements for the R-1 District. Parcel B, <br /> 785 square feet in area, is not being created for development since it will be <br /> consolidated with the property at 3651 Snelling Avenue as a part of this application. <br /> 3. It is determined that the proposed division will not be detrimental to the public <br /> welfare or injurious to adjacent tracts in the area in which the subdivision is located. <br /> The division will not negatively impact neighboring properties. <br /> Consolidation <br /> Section 22-12, (e) of the City Code authorizes the consolidation of platted lots of record <br /> if the following four conditions are met: <br /> 1. The owners of such platted lots to be consolidated shall file with the City Planner a <br /> survey or registered land survey of the lots to be consolidated. <br /> A survey of the property as it exists for 1543 Oak Avenue was submitted, showing <br /> Parcel B, the portion that is to be combined with 3651 Snelling Avenue. <br /> 2. The parcel resulting from the consolidation shall not have an area, dimensions or <br /> setbacks which are less than the minimum requirements specified for the zoning <br /> district in which the parcel is located in the Zoning Ordinance. <br /> The consolidated parcel will exceed all minimum dimensional criteria for the district <br /> and allow the property at 3651 Snelling Avenue to meet the minimum side yard <br /> setback requirements and become a conforming lot. Currently, the house at 3651 <br /> Snelling Avenue is located over the property line and is nonconforming by side yard <br /> setback. <br /> 3.
