<br /> <br /> <br /> <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: December 14, 2015 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> <br />FROM: Sue Iverson, Acting City Administrator <br /> <br />SUBJECT: Approve Publishing a Summary of Ordinance 2015-008 <br /> <br /> <br />Requested Action <br /> <br />Motion to approve publishing a Summary of Ordinance Number 2015-008 (A supermajority vote <br />is required for this motion. The City Attorney has notified the City that, despite the current <br />Council vacancy, a 4/4 vote is required for items that require supermajority approval). <br /> <br />Background <br /> <br />The City Council approved Ordinance Number 2015-008 at their regular meeting on November <br />30, 2015. The Ordinance grants a franchise to Qwest Broadband Services, Inc., D/B/A <br />CenturyLink, to construct, operate, and maintain a cable communications system in the City of <br />Arden Hills, setting forth conditions accompanying the grant of the franchise, providing for the <br />regulation and use of the system and the public rights-of-way ordinance, if any, and prescribing <br />penalties for the violation of the provisions herein. <br /> <br />Under Minnesota State law, the City is required to publish the ordinance in its official newspaper <br />within 45 days of being passed. The City Council may approve the publication of a summary of <br />the ordinance by a fourth-fifths vote of its members. The City Attorney has notified the City that, <br />despite the current Council vacancy, a 4/4 vote is required for items that require supermajority <br />approval.
