City of Arden Hills Personnel Policy Effective Fcbruar32 201-56 <br />applicant in writing of his or her right to: <br />a. Provide any information to the City within three (3)working days upon <br />receiving results of the tests that could explain the positive test result. <br />b. Receive a copy of the test result report. <br />C. Retest the original sample at their own expense provided they inform the <br />City Director of Administrative Services within five (5) <br />working days after receiving notice of the positive test result. <br />8. A positive test result,which has been confirmed indicating the presence of <br />illegal drugs, alcohol, or non-prescription drugs, may result in termination, <br />subject to the following: <br />a. An employee who tests positive for the first time will be given the <br />opportunity to participate in,at the employee's own expense,or pursuant <br />to coverage under the employee's benefit plan, a counseling or <br />rehabilitation program. <br />b. The employee may be discharged for any of the following reasons: <br />1) The employee tested positive on a previous occasion in a work- <br />related incident. <br />2) The employee refuses to participate in a chemical dependency or <br />rehabilitation program. <br />3) The employee fails to successfully complete chemical dependency <br />counseling or a rehabilitation program. <br />9. If an employee is called out for a City emergency and is suspected of being <br />under the influence of drugs or alcohol,he or she will not be subject to the <br />testing procedures of this policy. However, he or she will not be allowed to <br />work,and will be sent home. <br />10. Results of tests and other information acquired in the drug and alcohol-testing <br />process will be treated as private data on individuals as defined by MSA 13.02, <br />Subd. 12.
