Ordinance 2010-012 <br />� <br />shal} dedicate developable land to create an integrated, park, recreation, � <br />pathway and open space system that is open to the general public. Private <br />landscaping; pnvate pathways; and r�ghts-of-way, mcluding landscaped <br />medians and boulevards shall not count toward the park, recreation_ <br />pathway, and open space requirement. The park dedication requirement <br />shall be based on the total acreage of former TCAAP property made <br />available for sale by the General Service Administration, an behalf of the <br />United States Army. The area made available for sale may exceed the <br />combined area of the Mixed Business and Mixed Residential Zoning <br />Districts. The park dedication requirement shaIl be as follows based on <br />the total sale area: <br />Park Dedication Requirement <br />Total Sale Paric Dedication <br />Acres Requirement <br />up to 450 10% <br />450-469 14% <br />470-489 17% <br />490-509 21% <br />510-529 24% <br />530-549 27% <br />550-584 30°/a <br />585+ 34% <br />In lieu of the dedication of the land for recreational purposes, the City � <br />Council may require the developer to pay to the City, as an equivalent <br />contribution, an amount in cash equal to the percentage of the tand <br />required to be dedicated, multiplied by the fair market value of land <br />remediated to MPCA Tier II Residential SRV. The park dedication may <br />be divided between a land dedication and cash contribution at the <br />discretion of the City. <br />B. Park, Recreation, Pathway and Open Space Plan. A park, recreation, <br />and open space plan shall be prepared to serve the needs of the <br />development, including a capital improvement plan and maintenance <br />costs. The amenities within the plan shall be incorporated into the MR <br />and MB areas to meet the needs of the development. <br />l. The plan shall incIude at least one central community park of 20 <br />acres with the foitowing features: <br />a. A water feature designed to hold standing water, which may <br />also be used for stormwater management at the discretion of the <br />City. <br />b. At the ordinary water level of the water feat�re, it shall occupy <br />at least twenty-five (25%) percent of the total area of the park but � <br />shall not exceed fifty (50%) percent of the total area of the park. <br />Page 70 of 84 <br />
