On January 11, 2016, Boston Scientific submitted an application requesting <br />approval of a 13th Amendment to Master Planned Unit Development Agreement for the <br />following two requests: <br />• Site Plan Review for the construction of a skyway between Buildings 3 and 10 <br />and modifications to the surface parking lot on the north side of Building 10 at <br />4100 Hamline Avenue; and <br />• An extension of the March 1, 2016 deadline for the submittal of a Site Plan <br />Review for the modification of the parking area along the Lot 1 and Lot 2 <br />property line and the submittal of a building permit for the removal of the <br />existing skyway between Buildings B and E as required by the conditions of <br />approval in Planning Case 15-001. <br /> <br />3. CITY STAFF REVIEW. City staff reviewed the requests and pursuant to City Code <br />Section 1355.06 determined that the requests are insignificant and that the requirements of a <br />public hearing may be waived and the requests may be forwarded directly to the City Council. <br /> <br />4. CITY COUNCIL REVIEW. On February 29, 2016, the City Council reviewed the <br />application, the reports and recommendations of City’s staff, the reports of Boston Scientific, and <br />the recommendations of the City Planning Commission, and has approved the 13th Amendment <br />to Master Planned Unit Development Agreement, all subject to the terms and conditions herein <br />contained. <br /> <br />5. TERMS AND CONDITIONS. <br /> <br /> A. The project shall be completed in accordance with the plans submitted as <br />amended by the conditions of approval attached hereto as Exhibit A. Any significant changes to <br />these plans, as determined by the City Planner, shall require review and approval by the Planning <br />Commission and City Council. <br /> <br /> B. The current and subsequent owners of the Property shall continue to abide by the <br />conditions of all previous Development Agreements, Master PUD approvals, and subsequent <br />PUD Amendment approvals. <br /> <br /> C. All necessary City permits for the construction of the skyway and modifications <br />to the parking lot on the north side of Building 10 shall be obtained by September 1, 2017, or an <br />extension request shall be submitted in writing to the City at least forty-five (45) days prior to the <br />expiration date. <br /> <br /> D. Final construction plans shall be subject to approval by the City Building Official, <br />City Engineer, and Fire Marshall prior to the issuance of a Building Permit. <br /> <br /> E. Final grading, drainage, and utility plans shall be subject to approval by the City <br />Engineer prior to the issuance of a Grading and Erosion Control Permit. <br />
