ARDEN HILLS PLANNING COMMISSION – April 6, 2016 2 <br /> <br /> <br />City Planner Streff stated that the applicant is proposing to construct a new twenty six (26) foot <br />by twenty-eight (28) foot or 728 square foot detached accessory structure. As proposed, the new <br />structure would replace the deteriorating existing structure that is 400 square feet or twenty (20) <br />feet by twenty (20) feet in size. The proposed accessory structure would be placed in the rear yard <br />and in the same general location as the existing structure along the east property line. As defined <br />by the City Code the existing detached structure is considered to be non-conforming as the <br />structure encroaches five (5) feet into the ten (10) foot accessory structure setback along the east <br />property line. <br /> <br />City Planner Streff commented that in this case, the property owner is requesting a variance in <br />order to construct a larger accessory structure that would maintain the current five (5) foot <br />setback similar to that of the existing structure on the site today. If a variance is approved for this <br />project, the applicant would be permitted to encroach five (5) feet into the ten (10) foot side yard <br />setback. The applicant has indicated that the façade and roofing materials to be used on the new <br />detached accessory structure would match the materials on the existing home. <br /> <br />Site Data <br />Land Use Plan: Low Density Residential <br />Existing Land Use: Single Family Detached Residential <br />Zoning: R-2: Single & Two Family Residential <br />Current Lot Sizes: .2790 Acres (12,155 Square Feet) <br />Topography: Flat <br /> <br />City Planner Streff reviewed the surrounding area, the Plan Evaluation and the Variance <br />Evaluation Criteria. <br /> <br />City Planner Streff provided the Findings of Fact for review: <br /> <br />General Findings <br />1. That the property is in the R-2 Single & Two Family Residential Zoning District. <br />2. That the lot is 12,155 square feet in size with approximate dimensions of 65 feet in width <br />by 187 feet in depth. <br />3. That the total square footage of the lot meets the requirements in the R-2 Zoning District; <br />however, the actual dimensions of the lot do not meet the minimum size requirements. <br />4. That the existing accessory structure is non-conforming because the structure encroaches <br />five (5) feet into the required ten (10) foot setback along the east property line. <br />5. That the existing accessory structure on the property would be removed. <br />6. That a variance is required to encroach into the ten (10) foot accessory structure setback. <br />7. That the proposed detached accessory structure/garage would maintain the five (5) foot <br />encroachment into the setback along the east property line. All other setbacks for the <br />accessory structure meet Code requirements. <br />8. The proposed structure and landscape coverage on the property would be in conformance <br />with the lot coverage requirements of the R-2 Zoning District. <br />9. That the proposed accessory structure would not exceed the 15 foot height limit. <br />10. That detached accessory structures are permitted within the R-2 Zoning District. <br />11. That the proposed detached accessory structure is outside of the 100-year flood plain, <br />wetlands, and easements.
