GENERAL CONDITIONS 00700 - 2 <br />CHANGE ORDER #3 <br />(Attachment) <br /> <br /> <br /> <br />This contract is amended as follows: <br /> <br />WHEREAS: Work was necessary in the existing large rain water garden in Valentine Park to <br />remove sediment from the construction of the 2015 PMP Project at the <br />Contractor’s expense and the Contractor mobilized equipment to that area, <br /> <br />WHEREAS: It was determined that to improve the drainage and filtration properties of the <br />garden additional draintile and soil correction work was necessary; and <br /> <br />WHEREAS: That work was outside of the project scope. However, the Engineer directed the <br />Contractor to complete the work since equipment had been mobilized to that <br />area and reduced the cost of completing the work separately at another time. <br /> <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT: <br /> <br />1. The Contractor shall complete the above described changes and additions to the project. <br /> <br />2. Payment for the work was reviewed and approved by the Engineer. <br /> <br />3. The Contractor will not make claim of any kind or character for any other costs or <br />expenses that he may have incurred or that he may hereafter incur in performing the <br />work or furnishing the materials of this agreement. <br /> <br /> <br /> <br />
