187685v2 2 <br />C. This CUP agreement shall be signed by the applicant and approved by <br />Council prior to the issuance of any building permits. <br /> <br />D. That a building permit shall be obtained for the proposed improvements to <br />the athletic field complex. <br /> <br />E. That building permits for the proposed improvements shall be issued by <br />June 27, 2017, or an extension shall be requested at least 45 days preceding this deadline. <br /> <br />F. That a minimum of one (1) tree shall be planted within the Mounds View <br />High School property to meet the Zoning Code requirements. Each deciduous tree is <br />required to be a minimum of two and one-half (2.5) caliper inches and coniferous trees <br />are required to be six (6) feet in height. <br /> <br />G. That all building and setback requirements shall be met. <br /> <br />H. That an automatic dimmer module shall be installed to reduce the <br />nighttime light output of the LED lighting of the scoreboard based on ambient light <br />levels. <br /> <br />I. That the sound system being installed within the scoreboard shall meet all <br />applicable standards set by the EPA and MPCA. <br /> <br />J. That the applicant shall cooperate with all reasonable requests from the <br />City to modify direction and intensity of light and sound emitted from the scoreboard to <br />mitigate its impact. <br /> <br />K. That the scoreboard shall not be used as a dynamic sign to display <br />messages or videos. <br /> <br /> 4. Termination of Permit. The City may revoke the permit following a public <br />hearing for violation of the terms of this permit. <br /> 5. Lapse. If within one year of the issuance of this permit the allowed use has not been <br />completed or the use commenced, this permit shall lapse. <br /> 6. Criminal Penalty. Both the owner and any occupant of the subject property are <br />responsible for compliance with this conditional use permit. Violation of the terms of this <br />conditional use permit is a criminal misdemeanor. <br /> <br />
