<br />3 <br />188068v5 <br />consultants; the reports and comments of Developer; and the recommendation of the City Planning <br />Commission; and has approved the Phase 2-Final Plan, including approval of all variances from ordinance <br />codes or other requirements necessary to complete all of the improvments contemplated by or relating to the <br />Development; all subject to the terms and conditions contained herein. <br /> 2. TERMS AND CONDITIONS. In consideration of the above referenced City Council <br />approvals, in compliance with the provisions of the City’s Development Regulations, and in consideration <br />of the undertakings herein expressed, the parties agree: <br /> A. The City hereby approves the Phase 2-Final Plan on condition that the Developer enter into <br />this Agreement, furnish the security required by it, and record this Agreement with the Ramsey County <br />Registrar of Titles within sixty (60) days after the City Council approves thePhase 2-Final Plan. If this <br />Agreement is not recorded within sixty (60) days of the City Council’s approval, the approval shall be <br />considered void. <br /> B. Development Plans. The “City Planner” is the City’s Planner. The Subject Property shall <br />be developed in accordance with the following plans (collectively, the “Project Plans”). <br />1. Overall Site Plan <br /> 2. Selective Site Demolition Plan - Phase One <br /> 3. Selective Site Demolition Plan - Phase Two <br /> 4. Grading, Drainage and Erosion Control Plan - Phase One <br /> 5. Grading, Drainage and Erosion Control Plan - Phase Two <br /> 6. Utility Plan - Phase One <br /> 7. Utility Plan - Phase Two <br /> 8. Sanitary Sewer and Storm Sewer Plan <br /> 9. Public Watermain Plan <br /> 10. Paving and Geometric Plan - Phase One <br /> 11. Paving and Geometric Plan - Phase Two <br /> 12. Stormwater Pollution Prevention Plan - Phase One <br /> 13. Stormwater Pollution Prevention Plan - Phase Two <br /> 14. Landscape Plan – Phase 1 <br />15. Landscape Plan – Phase 2
