Tree Preservation Plan <br /> <br />The Project Plans shall not be attached to this Agreement but, upon approval by the City Council, shall be <br />deemed fully incorporated by reference into this Agreement as if initially set forth entirely herein. Any <br />significant changes to the Project Plans, as reasonably determined by the City Planner, shall require review <br />and approval by the City Planning Commission and the City Council. If the Project Plans, as approved by <br />the City Council, vary from the terms of this Agreement, the approved Project Plans shall control. <br />C. PUD Master Plan. <br />1. A “Master PUD Agreement” and a “Phase1 Development Contract” have been <br />prepared by the City Attorney for the City and have been approved by the City Council <br />and the Developer. The Master PUD Agreement and Final Phase 1 Development <br />Contract shall remain in full force and effect. <br />2. This Final Phase 2 Development Contract shall be executed prior to the issuance <br />of any Development permits for Phase 2. <br />D. Phase 2-Final Plan. <br />1. The Developer shall obtain a building permit within one (1) year of the Final <br />Phase 2 PUD approval or the approval shall expire unless extended by the City Council <br />prior to the approval’s expiration date. Extension requests must be submitted in writing <br />to the City at least forty-five (45) days prior to the expiration date. <br />2. The Developer shall provide a construction phasing plan that includes plans for <br />fire and police access throughout construction, subject to the approval of the Fire <br />Marshall, Public Works Director, and Ramsey County Sheriff prior to the issuance of any <br />Development permits.
