In these cases, the Zoning Code requires the lakeshore setback be <br />determined by taking the average setback of the two adjacent dwellings and subtracting 10 feet. <br />The required lakeshore setback for 1500 Arden Place has been calculated at 80 feet – 2 inches. A <br />variance is needed for the dwelling to encroach 15 feet – 9 inches into this required setback. <br />Decks may extend up to six feet into a required structure setback, and in this case a deck could <br />be 74 feet – 2 inches from the shoreline. A portion of the deck on the south side of the house <br />would extend 15 feet – 4 inches into this setback. Additionally, a corner of the attached garage <br />would encroach 2 feet into the 40-foot minimum front yard setback. <br /> <br />The applicants have submitted a letter describing the project in more detail and addressing each <br />of the variance criteria (Attachment A). The proposed site plan and preliminary building plans <br />are included in Attachments E and F. <br /> <br /> <br />Plan Evaluation <br /> <br />A full evaluation of the proposal was presented to the Planning Commission at their meeting on <br />September 7, 2016. The staff report to the Planning Commission is included in Attachment I. <br /> <br /> <br />Additional Review <br /> <br />Building Official <br />The Building Official has reviewed the plans and has no additional comments at this time. A <br />Building Permit will be required prior to construction. <br /> <br />City Engineer <br />The City Engineer has reviewed the plans and has no additional comments at this time. A <br />Grading and Erosion Control Permit will be required prior to construction. <br /> <br />Rice Creek Watershed District <br />The Rice Creek Watershed District has reviewed the proposed project and determined that no <br />permit will be required. <br /> <br />Minnesota Department of Natural Resources <br />Municipalities are required to provide the Minnesota Department of Natural Resources (DNR) <br />with a copy of the variance request for properties within designated shoreland areas at least 10 <br />days before the public meeting. Staff notified the DNR about this application on August 24, <br />2016. No comments have been provided by the DNR at this time. <br /> <br /> <br /> <br />
