Joynes, Sr., City Administrator <br /> <br />FROM: Matthew Bachler, Senior Planner <br /> <br />SUBJECT: Planning Case #17-007 <br /> Applicant: Burt and Kim Swanson <br /> Property Location: 3517 Siems Court <br /> Request: Variance <br /> <br /> <br />Requested Action <br /> <br />Motion to approve Planning Case 17-007 for a front yard setback variance at 3517 Siems Court, <br />based on the findings of fact and submitted plans, as amended by the four conditions in the April <br />24, 2017, Report to the City Council. <br /> <br /> <br />Background <br /> <br />The property at 3517 Siems Court is located in the R-1 District on the northeast side of Lake <br />Johanna. The applicants have proposed taking down the existing dwelling on the property and <br />constructing a new single-family home. The new dwelling would be located in a similar footprint <br />to the existing dwelling. The existing house on the property is considered to be legal <br />nonconforming because it is setback 21.3 feet from the front property line and a 40-foot front <br />yard setback is required. <br /> <br />The new house would consist of one level with a walkout basement facing Lake Johanna. <br />Overall, the structure would have an area of 2,549 square feet. Included in this footprint are a <br />792 square foot attached garage and a 64 square foot porch. <br /> <br />One setback variance is needed for the proposed dwelling. The required front yard setback in the <br />R-1 District is 40 feet. Due to other considerations on the lot, the applicants have proposed at 25- <br />foot front yard setback. A variance is needed for the dwelling to encroach 15 feet into the <br />required setback.
