The proposed site plan and preliminary building plans <br />are included in Attachments C and D. <br /> <br /> <br />Plan Evaluation <br /> <br />A full evaluation of the proposal was presented to the Planning Commission at their meeting on <br />April 5, 2017. The staff report to the Planning Commission is included in Attachment G. <br /> <br /> <br />Additional Review <br /> <br />Building Official <br />The Building Official has reviewed the plans and has no additional comments at this time. A <br />Building Permit will be required prior to construction. <br /> <br />City Engineer <br />The City Engineer has reviewed the plans and noted that a Grading and Erosion Control permit <br />will be required. The City Engineer previously commented that a retaining wall in the rear yard <br />was shown being constructed within the utility easement and over a sewer main. The applicant <br />has submitted a revised plan with a modified retaining wall that does not encroach on the <br />easement area (Attachment C). <br /> <br />Rice Creek Watershed District <br />The Rice Creek Watershed District has reviewed the proposed project and determined that no <br />permit will be required. <br /> <br />Minnesota Department of Natural Resources <br />Municipalities are required to provide the Minnesota Department of Natural Resources (DNR) <br />with a copy of the variance request for properties within designated shoreland areas at least 10 <br />days before the public meeting. Staff notified the DNR about this application on March 21, 2017. <br />No comments have been provided by the DNR at this time. <br /> <br /> <br />Findings of Fact <br /> <br />The Planning Commission reviewed Planning Case 17-007 at their regular meeting on April 5, <br />2017. Draft minutes from the meeting are included in Attachment H. The Planning Commission <br />offers the following findings of fact for consideration: <br /> <br />General Findings: <br />1. The property at 3517 Siems Court is located in the R-1 Single Family Residential Zoning <br />District.
