Joynes, Sr., City Administrator <br /> <br />FROM: Matthew Bachler, Senior Planner <br /> <br />SUBJECT: Planning Case 16-032 <br /> Applicant: City of Arden Hills <br />Request: Ordinance No. 2016-013 – Slow-No Wake Speed Restrictions <br /> <br /> <br />Requested Action <br /> <br />1. Motion to approve Ordinance No. 2016-013: An Ordinance Amending Chapter 7, Section <br />700.06 of the City Code to adopt slow-no wake speed restrictions on Lake Johanna <br />during specified high water periods. <br /> 2. Motion to approved publishing a summary of Ordinance No. 2016-013. <br /> <br /> <br />Background <br /> <br />This case was previously reviewed by the City Council at their regular meeting on December 12, <br />2016. The Council discussed the Ordinance amendment and approved its submittal to the <br />Minnesota Department of Natural Resources (DNR) for review. The staff report from the <br />December 12, 2016 meeting is included in Attachment D. <br /> <br />Following their review, the DNR recommended that two changes be made to the Ordinance prior <br />to final adoption: <br /> <br />• Incorrect lake number. There are two lakes named “Johanna” in Minnesota. The <br />Ordinance was updated to reflect the correct lake number. <br /> <br />• Penalty section added. The DNR was concerned that penalties for violation of the <br />Ordinance were not specifically stated in Chapter 7, Section 7 – Lakes. Staff updated the <br />Ordinance to include “Violation of Penalty” language found elsewhere in Chapter 7 of <br />the City Code.
