ARDEN HILLS CITY COUNCIL – SEPTEMBER 25, 2017 7 <br /> <br />Ms. Anderson addressed the Council again and encouraged the City to be in contact with <br />homeowners to explain which plants and shrubs would need to be moved. <br /> <br />Mayor Grant closed the public hearing at 8:26 p.m. <br /> <br />MOTION: Councilmember McClung moved and Councilmember Holmes seconded a <br />motion to Adopt Resolution #2017-034 Ordering the Improvement and <br />Preparation of Plans and Specifications for the 2018 Street and Utility <br />Improvement Project. <br /> <br />Mayor Grant encouraged staff to get the drainage right on this project given the number of <br />concerns voiced by the residents. <br /> <br />Councilmember McClung seconded these remarks. <br /> <br />Councilmember Holmes stated she lived in the neighborhood within the 2015 PMP and <br />commented on how well staff working on the project communicated with the affected residents <br />throughout this project. <br /> <br />Councilmember Scott commented he would like to see the neighborhood remain homogenous <br />and for this reason recommended the Council consider surmountable curbs. <br /> <br />The motion carried (5-0). <br /> <br />B. Ordinance 2017-007 – An Ordinance Authorizing Small Cell Wireless <br />Facilities to be located within Public Right of Way as Mandated by the 2017 <br />Legislature Amending Chapter 3, Section 360, Rights-of-Way, of the Arden <br />Hills City Code and Authorizing Publication of Summary Ordinance <br /> <br />Public Works Director/City Engineer Polka stated a new law enacted during the 2017 <br />legislative session allows small cell wireless equipment to be placed on city-owned infrastructure <br />in the public right of way. As introduced, the bill would have allowed wireless companies <br />unregulated access to the public right of way, but due to opposition, the resulting bill language <br />preserves local authority over access to the public right of way. Staff reviewed the proposed <br />changed to City Code and recommended adoption of Ordinance 2017-007. <br /> <br />Mayor Grant opened the public hearing at 8:36 p.m. <br /> <br />With no one coming forward to speak, Mayor Grant closed the public hearing at 8:36 p.m. <br /> <br />Councilmember McClung thanked staff and City Attorney Jamnik for their work on this <br />Ordinance. <br /> <br />MOTION: Councilmember McClung moved and Councilmember Holden seconded a <br />motion to adopt Ordinance #2017-007, An Ordinance authorizing Small Cell <br />Wireless Facilities to be located within Public Rights of Way as Mandated by
