2 <br />195005V1 <br />Lexington Avenue. Since receiving the approval for the expansion, Boston Scientific has <br />identified additional site improvements as part of the expansion. <br /> <br /> D. On October 24, 2017, Boston Scientific submitted an application requesting <br />approval of a 15th Amendment to Master Planned Unit Development Agreement to expand the <br />paved area adjacent to the sterilization facility, widen the curb cut for the existing driveway on <br />Cummings Park Drive, and reduce the length of the center island in Cummings Park Drive <br />(“Project”). As stated in the application and project narrative submitted by Boston Scientific, the <br />purpose of the Project is to improve truck mobility in and out of the loading docks and service <br />areas on the north side of Building 9 and reduce conflicts with passenger vehicles and <br />pedestrians. <br /> <br /> E. For building construction or site modifications not included on the Master Plan, <br />an Amendment to the Planned Unit Development Agreement is required. The proposed <br />expansion of the paved area adjacent to Building 9 and the driveway expansion on Cummings <br />Park Drive are not identified on the approved Campus Master Plan. <br /> <br />3. CITY STAFF REVIEW. City staff reviewed the requests and application of Boston <br />Scientific for the Project and pursuant to City Code Section 1355.06 determined that the <br />proposed requests are insignificant, that the requirements of a public hearing may be waived and <br />the requests may be forwarded directly to the City Council. <br /> <br />4. CITY COUNCIL REVIEW. On November 13, 2017, the City Council reviewed the <br />application, the reports and recommendations of City’s staff, and the reports of Boston Scientific, <br />and has approved the 15th Amendment to Master Planned Unit Development Agreement, all <br />subject to the terms and conditions herein contained. <br /> <br />5. TERMS AND CONDITIONS. <br /> <br />A. The Project shall be completed in accordance with the plans submitted as <br />amended by the conditions of approval. Any significant changes to these plans, as determined <br />by the City Planner, shall require review and approval by the Planning Commission and City <br />Council. <br /> <br />B. The current and subsequent owners of the Property shall continue to abide by the <br />conditions of all previous Development Agreements, Master Planned Unit Development <br />approvals, and subsequent Planned Unit Development Amendments, and Planned Unit <br />Development approvals. <br /> <br />C. The Applicant shall obtain all necessary permits, including, but not limited to, a <br />City Right-of-Way Permit for all work completed within the City’s right-of-way. Copies of all <br />necessary permits shall be submitted to the City prior to the issuance of any development <br />permits. <br />
