The accessory structure requires a <br />variance from both of the side yard setback requirements. <br /> <br /> <br />Background <br /> <br />1. Overview of Request <br /> <br />The property at 3415 Lake Johanna Boulevard is located in the R-2 District on the west side of <br />Lake Johanna. The property has frontage on Lake Johanna Boulevard, but is accessed from the <br />alley off of Fairview Avenue. The applicant previously moved a detached garage from the <br />adjacent property at 3417 Lake Johanna Boulevard on to the property without a Building Permit. <br />The structure was placed on a concrete apron in front of the existing detached garage on the <br />property. The two structures are separated by approximately three feet. The City typically <br />requires a minimum of six feet of separation between structures, or if that separation is not met <br />that certain fire protection improvements are completed. The property also has an existing small <br />storage shed located in the southwest corner of the lot. Residential lots are not permitted more <br />than two accessory structures and the applicant has agreed to remove the shed if the variance is <br />approved. <br /> <br />The applicant has applied for a variance in order to allow the detached garage to remain in place. <br />A variance is needed in this case because the garage encroaches on the 10-foot side yard setback
