Background On May 22, 2017, the City Council approved the plans for a building addition at the Health Partners clinic on Northwoods Drive (Planning Case 17-011). As a condition of approval for the Rice Creek Watershed District (RCWD) permit for the project, a Maintenance Agreement for the stormwater pond on the property was required. This stormwater pond is used by Health Partners and other properties in the area, and a Grant of Permanent Easement between the City and Health Partners obligates the City to perform maintenance on the non-landscaped portion of the pond (Attachment B). The City Council approved the required Maintenance Agreement with RCWD on May 22, 2017. Since then, RCWD has requested that the City sign a revised version of the Maintenance Agreement (Attachment C). The City Attorney and the Public Works Director/City Engineer have reviewed the Agreement and it is acceptable as drafted.
