Sewer and water for the subdivision shall be obtained by connections to the City water <br />and sewer systems. Extension of City services shall be subject to review and approval by <br />the City Engineer and all associated costs shall be the responsibility of the developer. <br />16. A grading as-built and utility as-built plan shall be provided to the City upon completion <br />of grading and utility work. <br />17. The deck on the existing single-family dwelling at 3685 New Brighton Road shall be <br />removed or modified in order to meet the side yard setback requirement and not encroach <br />on any drainage and utility easement prior to the issuance of a building permit for Lot 1 <br />or Lot 2, or the Developer shall be required to submit a cash escrow with the City to <br />ensure the removal of the deck within six (6) months from the approval of the Final Plat. <br />18. The driveway for the existing single-family dwelling at 3685 New Brighton Road shall <br />be relocated to Thom Drive prior to the issuance of a building permit for Lot 1 or Lot 2, <br />or the Developer shall be required to submit a cash escrow with the City to ensure the <br />relocation of the driveway within six (6) months from the approval of the Final Plat. <br />19. The Developer shall conform to all other City regulations. <br /> <br /> <br />Public Comments <br /> <br />Staff has received emails from seven residents within the surrounding area. Copies of these <br />emails have been provided in Attachment K. Staff received a phone call from the resident at <br />2033 Thom Court who expressed concerns about drainage issues. Staff also spoke to the resident <br />at 2027 Thom Drive who had concerns about the proposal. <br /> <br />The Planning Commission held the official public hearing for Planning Case 17-029 at their <br />meeting on January 10, 2018. Public comments were also taken at the Planning Commission <br />meeting on February 7, 2018. Minutes from the meetings have been provided in Attachments M <br />and N. The following is a summary of the comments provided at the meetings: <br /> <br />• The resident at 3695 New Brighton Road described how the proposed development <br />would affect energy efficiency systems and designs within their home. The resident also <br />expressed concerns about the number of trees removed, the impact on the wetland, the <br />number of additional driveways on Thom Drive, the size of the lots in comparison to <br />other properties in the area, the proposed stormwater management plan, and the easement <br />vacation. <br />• The resident at 3670 New Brighton Road expressed concerns about the impact of the <br />development on the wetland area. <br />• The resident at 3744 Brighton Way expressed concerns about the impact of the <br />development on the wetland area, the number of trees that would be taken down, and the <br />proposed partial vacation of the easement area for the lift station. The resident also had <br />concerns about additional traffic on Thom Drive. <br />• The resident at 3707 New Brighton Road expressed concerns about how the character of <br />the neighborhood would be impacted by the development.
