The City hereby grants approval to the Development as identified in Plans A <br />through M in paragraph 4 of this Agreement and compliance with the terms and conditions of this <br />Agreement and all other City requirements which are in effect. <br /> 3. RIGHT TO PROCEED. Within the plat or subject property, the Developer may <br />not grade or otherwise disturb the earth, remove trees, construct sewer lines, water lines, streets, <br />utilities, public or private improvements, or any buildings until all the following conditions have <br />been satisfied: 1) this Agreement has been fully executed by both parties and filed with the City <br />Clerk, 2) the necessary security has been received by the City, 3) the plat, if any, and this <br />Agreement have been recorded with the Ramsey County Recorder's/Registrar’s Office within sixty <br />(60) days of City Council approval, and 4) the City’s Administrator has issued a letter that the <br />Developer may proceed. If the plat and this Agreement are not recorded within sixty (60) days of <br />City Council approval, the approval shall be considered void. <br /> 4. DEVELOPMENT PLANS. The plat or property shall be developed in <br />accordance with the following plans (“Plans”). The Plans shall not be attached to this Agreement. <br />The Plans may be prepared, subject to City approval, after entering the Agreement, but before <br />commencement of any work in the plat or on the property. If the Plans vary from the written terms <br />of this Agreement, the approved plans shall control. <br /> The Plans are: <br /> Plan A – Cover Sheet, dated 03/15/2018 <br /> Plan B - Legend Sheet, dated 03/15/2018 <br /> Plan C – Preliminary Plat and Existing Conditions, dated 03/15/2018 <br /> Plan D - Site/Utility Plan, dated 03/15/2018 <br /> Plan E – Grading Plan, dated 03/15/2018 <br /> Plan F – Erosion Control Plan, dated 03/15/2018 <br /> Plan G – Details, dated 03/15/2018
