A Building <br />Permit and Grading and Erosion Control Permit will be required for the construction of a new <br />dwelling on Parcel A. The applicant has noted that Wonderful Home Builders will remodel the <br />existing dwelling on Parcel B for sale. In addition to the existing dwelling on Parcel B, there is <br />also a detached garage and shed located in the rear yard. <br /> <br /> <br />Plan Evaluation <br /> <br />A full evaluation of the proposal was presented to the Planning Commission on March 7, 2018. <br />The staff report to the Planning Commission on this case is provided in Attachment E. <br /> <br /> <br />Park Dedication <br /> <br />The Subdivision Code requires developers of subdivisions to dedicate to the public a reasonable <br />percentage of the tract to be developed. Section 1130.08 Subd. 3 of the Subdivision Ordinance <br />indicates for a subdivision that results in new dwelling units of less than 2.5 units per acre, the <br />applicant shall dedicate 10 percent of the buildable land area in the subdivision or pay a park <br />development fee of $6,500 per residential unit. Ten percent of the development site would be <br />0.16 acres and would not allow for a feasible public park. <br /> <br />The Planning Commission discussed the required park development fee for the subdivision. The <br />staff recommendation was to require the park development fee of $6,500 only for the new single- <br />family residential lot (Parcel A). This recommendation was based on Section 1130.08, Subd. <br />3(F)(6) of the Subdivision Code, which states the following: “Property being subdivided without <br />an increase in the number of lots shall be exempt from park dedication requirements if similar <br />requirements were satisfied in conjunction with an earlier subdivision. If the number of lots is <br />increased, then the dedication shall be based on the additional lots created.” <br /> <br />Planning Commissioner Lambeth questioned why the park development fee would not also be <br />applied to the existing property (Parcel B). Commissioner Lambeth has provided a letter <br />explaining why he believes the park development fee should apply to each of the proposed <br />properties in this case (Attachment G). <br /> <br /> <br />Additional Review <br /> <br />City Building Official <br />The City Building Official has reviewed the proposed Minor Subdivision and does not have any <br />comments at the time. <br /> <br /> <br />
