3 <br />196919v3 <br />(4) The Academic Commons addition will require a City Grading and Erosion <br />Control Permit and a Rice Creek Watershed District Permit. <br />(5) The Aviary Support Facility addition shall comply with the type of construction <br />it is attached to (i.e. plans, materials, etc.). The existing type of construction is <br />1-B and the materials and exterior cladding of the new addition shall be verified <br />and approved by the City. <br />(6) Bethel shall obtain the necessary building permits for the Project from the City. <br />The building permit for the Brushaber Commons building addition shall be <br />issued within (1) year of the City granting approval of Planning Case 18-003, or <br />an extension shall be request at least forty-five (45) days preceding this deadline. <br />(7) The variance request shall comply with the purpose and intent of the provisions <br />of the City’s Zoning Regulations and with the policies of the City’s <br />Comprehensive Plan. <br />(8) Both buildings additions shall be fire sprinkler protected pursuant to State <br />Chapter 1306. <br />(9) Bethel shall be required to provide vegetative screening or other type of buffer <br />along Valentine Lake shoreline at the time of Site Plan Review for the Academic <br />Commons building addition. <br />(10) This Conditional Use Permit and Master Plan Amendment and Variance <br />Approval shall be recorded against the Subject Property. <br /> <br />5. Termination of Permit. The City Council may revoke this permit following a public <br />hearing for violation of the terms of this permit. <br /> <br />6. Lapse. If within one (1) year of the issuance of this permit the allowed use has not been <br />completed or the use commenced, this permit shall lapse. <br /> <br />7. Compliance.
