The addition would be set back <br />118 feet from the lakeshore thereby encroaching approximately 32 feet. <br /> <br /> D. At a public hearing on the 7th day of March, 2018, the Arden Hills Planning <br />Commission reviewed Bethel’s application, the report and recommendations of the Arden Hills City <br />Planner, the comments made by the public during the public hearing, and recommended approval of <br />the Conditional Use Permit and Master Plan Amendment and Variance, subject to certain <br />conditions, to the City Council. <br /> <br /> E. On the 26th day of March, 2018, the Arden Hills City Council considered the <br />recommendations of the Planning Commission, the comments made during the public hearing on <br />March 7, 2018, the effects of the proposed Project on the health, safety, convenience, and general <br />welfare of the owners and occupants of the surrounding land, and the community as a whole, and <br />passed a motion approving Planning Case No. 18-003, subject to certain conditions enumerated <br />herein. <br /> <br />2. Permit. Subject to the terms and conditions set forth herein, the City hereby grants a <br />Conditional Use Permit and Master Plan Amendment and Variance to Bethel for the construction of <br />two additions, the Aviary Support Facility and the Academic Commons building. <br /> <br />3. Property. The Conditional Use Permit and Master Plan Amendment and Variance is for <br />the following described property in the City of Arden Hills, Ramsey County, Minnesota: <br /> <br />Those parts of Sections 21, 22, 27 and 28, Township 30, Range 23, <br />lying Westerly and Southerly of the westerly and southerly right-of- <br />way lines of State Trunk Highway No. 51 and Interstate Highway <br />694 lying northerly of the northerly right-of-way line of the Canadian <br />Pacific Railroad Company and lying northerly and easterly of the <br />northerly and easterly right-of-way lines of State Trunk Highway No. <br />10, except the South ¼ of the Southeast ¼ of the Southeast ¼ of the <br />Section 21, Township 30, Range 23, lying east of the easterly line of <br />Highway No. 10, according to the U.S. Government Survey thereof <br />(herein the “Subject Property”) <br /> <br />4. Conditions. The Conditional Use Permit and Master Plan Amendment and Variance is <br />issued subject to the following ten (10) conditions: <br /> <br />(1) That the Project shall be completed in accordance with the plans submitted as <br />amended by the conditions of approval. Any significant changes to these plans, <br />as determined by the City Planner, shall require review and approval by the <br />Planning Commission and City Council. <br />(2) Bethel shall continue to abide by all previous agreements and Conditional Use <br />Permits, as amended b y the conditions of approval of the application. <br />(3) A Site Plan Review application, and a Zoning Code Compliance review, will be <br />required prior to construction of the Academic Commons building addition.
