If the City determines that there is not <br />sufficient space on a site for the replacement tree plantings, the Developer shall work <br />with the City to find an alternative off-site location, or a fee in lieu of the replacement <br />trees will be required equaling the cost of materials and installation plus ten (10%) <br />percent, as determined by the City Council. <br />10. Before construction, grading, or land clearing begins, Developer shall visibly mark trees <br />or tree areas that are to be preserved and city-approved tree protection fencing or other <br />method shall be installed and maintained at the critical root zones of the trees to be <br />protected. <br />11. The Developer shall submit a financial surety in the form of a Letter of Credit issued by <br />a FDIC-insured Minnesota bank in the amount of 125 percent of the cost of materials <br />and installation for the required replacement tree plantings prior to the issuance of any <br />development permits. The City will hold the letter of credit for two full years from the <br />date of the installation of the replacement trees. The letter of credit should not expire <br />during the two-year period. <br />12. Survey monuments shall be placed and installed at all block corners, angle points, <br />points of curves in streets, and at intermediate points as shown on the Final Plat. Pipes <br />or streel rods shall be placed at the corners of each lot. <br />13. The Developer shall install wetland monument signs to adequately define the wetland <br />buffer area, subject to the approval of the Public Works Director. <br />14. The Developer shall obtain sanitary sewer and water for the subdivision by connections <br />to the City water and sewer systems. Extensions of the City services shall be subject to <br />review and approval by the City Engineer, prior to the issuance of any building permits, <br />and all associated costs shall be the responsibility of the Developer. <br />15. That upon completion of grading and utility work on the site, a grading as-built and <br />utility as-built shall be provided to the City for review. <br />16. That the driveway openings providing access to each lot will be constructed off New <br />Brighton Road and that the width of each driveway will be approved by the City prior <br />to the issuance of any building permits. <br />17. That the project may require permits, including, but not limited to, MPCA-NPDES, <br />Rice Creek Watershed District, Minnesota Department of Health, MPCA- Sanitary <br />Sewer Extension, Ramsey County and City Right of Way, and City Grading and <br />Erosion Control permits. Copies of all issued permits shall be provided to the City prior <br />to the issuance of any building permits. <br />18. The Developer shall comply with all other applicable provisions of the City Code, City <br />regulations and related Ordinances.
